Terms used

“Personal data” refers to any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by assignment to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more special features that express the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person. “Processing” is any operation carried out with or without the aid of automated procedures or any such series of operations in connection with personal data. The term has an extensive meaning, thus covering practically all handling of data. The “Controller” is the natural or legal person, authority, institution or other body that, alone or together with others, decides on the purposes and means of processing personal data.

Applicable legal bases

In accordance with Art. 13 GDPR, we will inform you of the legal basis of our data processing. If the legal basis is not mentioned in the declaration on data protection, the following applies: Art. 6 Para. 1 lit. a and Art. 7 GDPR constitute the legal basis for obtaining consent; Art. 6 Para. 1 lit. b GDPR constitutes the legal basis for processing for the performance of our services and fulfilment of contractual measures and also for answering inquiries; Art. 6 Para. 1 lit. c GDPR constitutes the legal basis for processing to fulfil our legal obligations and Art. 6 Para. 1 lit. f GDPR constitutes the legal basis for processing to protect our legitimate interests. Article 6 Para. 1 lit. d GDPR serves as the legal basis in the event that the vital interests of the data subject or another natural person require the personal data to be processed.

Analysing accesses using Matomo

This site uses Matomo which is open source software for the statistical analysis of user accesses. Matomo uses cookies, text files that are saved on users' computers and are used to analyse how users use the website. The information about the use of this site created by the cookie is saved on the supplier's server in Germany. The IP address is anonymised immediately after processing and before it is saved. Users can prevent cookies being installed by configuring their browser software appropriately but the supplier advises users that in this case they may not be able to use all the functions of this website fully.

Data of page views

When individual pages and their offers are viewed, data are stored anonymously in a log file. The storage is exclusively for internal systems and statistical purposes.

In detail, the following data set is stored for each Retrieval:

  • error messages,
  • name of the retrieved file,
  • date and time of retrieval,
  • volume of data transferred,
  • description of the type of web browser used,
  • requesting Domain.

No personal data are stored for this. This website exclusively uses this information to constantly improve and update the website and thus increase the offers’ attractiveness.

Using personal data

Personal data is only collected if users provide this voluntarily, e.g. when registering, by filling in forms or by ordering information material. IWAKI Europe GmbH uses this data to answer queries and to inform users of the company's offers and services in future. It is not forwarded to third parties either for commercial or non-commercial purposes.

Cooperation with processors and third parties

If we disclose data to other persons and companies (processors or third parties) within the scope of our processing, transfer them to these persons and companies, or otherwise grant them access to the data, this shall only take place on the basis of a legal permission (e.g. in accordance with Art. 6 Para. 1 lit. b GDPR, if a transfer of the data to third parties is necessary to fulfil the contract, such as to providers of payment services), if you have given your consent or if a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.). Should we commission third parties to process data on the basis of a so-called “processing contract”, this is done in keeping with Art. 28 GDPR.

Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs in the context of using third-party services or if data are disclosed or transferred to third parties, this only takes place for the fulfilment of our (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissibility, we process or allow the data to be processed in a third country only if this meets the special requirements set forth in Art. 44 et seqq. GDPR. For example, this means that processing is carried out on the basis of special safeguards, such as the officially recognised determination of a data protection level which corresponds to that of the EU (e.g. for the US by the "Privacy Shield") or in compliance with officially recognised special contractual obligations (so-called "Standard Contractual Clauses").

Permission

By using our website and entering your personal data voluntarily, e.g. on our online registration form, you agree to the data being used for the specified purposes. Your personal data will not be processed further or passed on to third parties without your consent.

Rights of data subjects

In accordance with Art. 15 GDPR, you have the right to request confirmation as to whether the data concerned is being processed as well as to request information about this data, any further information and a copy of the data. Correspondingly, in accordance with Art. 16 GDPR, you have the right to request the data concerning you is complete or to have any inaccurate data concerning you rectified. In accordance with Art. 17 GDPR, you have the right to demand that data on you is immediately erased or, alternatively and in accordance with Art. 18 GDPR, to demand a restriction on the processing of your data. In accordance with Art. 20 GDPR, you have the right to request receiving the data on you that you have provided us with and to request its transfer to other controllers. Furthermore, in accordance with Art. 77 GDPR, you also have the right to lodge a complaint with the competent supervisory authority.

Right of revocation

In accordance with Art. 7 Para. 3 GDPR, you have the right to revoke the consents you have granted with future effect.

Right to object

In accordance with Art. 21 GDPR, you can object to the future processing of the data concerning you at any time. In particular, the objection may be made against processing for purposes of direct marketing.

Security

IWAKI uses up-to-date technical security measures to protect the data provided from accidental or deliberate manipulation, loss, destruction or access by unauthorised parties. When personal data is collected and processed the information is transferred in encrypted form.

SSL or TLS encryption

For reasons of security and to protect the transfer of confidential content, such as requests that you send us as the site operator, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from http:// to https:// and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.

Cookies, control elements and scripting

Certain offers and/or services of this website use so-called cookies; these are small text files that are stored on your computer and allow the website to look after the user and automatically recognise him/her upon his/her next visit. Cookies enable the full use of the services of this website. If you do not wish cookies to be stored, please set your Internet browser so that it erases cookies from your computer hard disk, blocks all cookies or warns you prior to storing a cookie.

If you leave our website via a link or by clicking on any banner advertisements and thus access external sites, it is possible that cookies may also be set by the addressee of the target site clicked on. Validity

Cookies are only valid for your visit to our portal. When you close the browser they are only deleted in accordance with your personal settings. There is no link to your personal data

Most browsers are set in such a way that they accept cookies automatically. You can, however, disable the saving of cookies or set you browser in such a way that it informs you as soon as cookies are set.

Correspondence partner

As part of our business activities, we may contact you directly or by correspondence. We would like to point out that your direct contact data (extension and e-mail address) will be stored with us with the data of your company. If the contact person in your company changes, please let us know. We will then erase your direct contact details and replace them with those of the new member of staff.

We use this data to answer inquiries and to inform you in the future about offers and services of the company.

Storage period

The transmitted personal data will be kept for 10 years in the case of a conclusion of contract according to §§ 238, 257 IV HGB / § 147 II AO. The personal data transmitted by the contact form, for which further storage is not required, will be deleted after 3 months.
